Successful prosecution of working men’s club

Cannock Chase Council has successfully prosecuted Chadsmoor Progressive Working Men’s Club for failing to comply with a noise abatement notice.

The notice was served on the premises in August 2015 following an investigation into complaints that live bands playing at the premises were causing a noise nuisance. The Council continued to receive complaints of noise nuisance following service of the notice and officers confirmed the noise levels to be excessive on nights when the live bands were playing.

Despite numerous warnings the club continued to host live bands at the premises, giving rise to noise nuisances.

At Cannock Magistrates Court on Monday 14 November 2016, the Club admitted breaching the abatement notice on three occasions, when live bands had played at the premises. The noise from all three events had been witnessed by Council Officers and confirmed to be a statutory nuisance. Evidence was also supplied by a number of residents adversely affected by the noise.

Chadsmoor Progressive Working Men’s Club was fined £4,500, with a statutory surcharge of £170 and costs of £5,344, totalling £10,014.

Steve Shilvock, Head of Environmental Health said, “Cannock Chase Council takes noise complaints very seriously. Our Environmental Health Department will work with the operators of premises if problems are found. However, where they continue to cause a nuisance to residents, the Council will take the most appropriate course of action, which in this case was prosecution.”
