A privacy notice is a statement that describes how the Council collects, uses, retains and discloses personal information. Different Organisations sometimes use different terms and it can be referred to as a privacy statement, a fair processing notice or a privacy policy.

To ensure that we process your personal data fairly and lawfully we will inform you of how we use your data including, but not limited to:

  • How it will be used
  • With whom it will be shared and
  • That Cannock Chase Council is the data controller for information we collect and process.

Overview

Cannock Chase Council is committed to compliance with Data Protection legislation. Keeping your personal information accurate and secure is a vital part of providing efficient services to you.

The council will only use the information it holds about you for the purpose you provided it except in the circumstances outlined in this notice. It will also only collect the minimum information necessary to fulfil that purpose.

When you provide information please be aware that the council is required to share your information, on occasion, between different sections of the council. Where required it may also be shared with other agencies where allowed or required by law, one example of this would be to help reduce crime or investigate fraud. Another example of this is in reducing Housing Benefit fraud and involves the council sharing /comparing data from other departments to ensure that claimants are not claiming illegally.

The council also works with other councils and community organisations and sometimes needs to share information with them in order to deliver your services. However, the council will not supply these organisations with your information unless it is satisfied that equal measures are in place to protect the information from unauthorised access. The council will also not supply your information to any organisation for marketing purposes without your prior consent.

The council has a responsibility to promote social wellbeing and works in partnership with other councils and agencies such as the Police, Fire and Rescue Service, the voluntary services and the Health Service in order to preserve life, reduce accidents, reduce crime and disorder and improve health. To promote this social wellbeing the council may need to share your personal and sensitive information with other councils and partner agencies.

Your Rights

Data protection legislation provides the following rights for individuals:

The right to be informed

  • You have the right to be informed about the collection and use of your personal data such as the purposes for processing your personal data, retention periods for that personal data, and who it will be shared with. This is provided when you provide us with your personal information and also within the privacy notices on this webpage.
  • If we obtain your personal data from other sources, we will provide you with privacy information within a reasonable period of obtaining the data and no later than one month. This will only happen where you have not already been informed that your data will be passed to us.

The right of access

The right to restrict processing

Individuals have the right to restrict the processing of their personal data where they have a particular reason for wanting the restriction.
This may be because you have issues with the content of the information we hold or how we have processed your data.

The right to restrict processing can apply when:

  • An individual contests the accuracy of their personal data and you are verifying the accuracy of the data;
  • The data has been unlawfully processed and the individual opposes erasure and requests restriction instead;


The right to data portability

This generally applies to instances where you wish to 'move' to another service provider - e.g. moving banks or phone providers. The right to data portability allows individuals to obtain and re-use their personal data for their own purposes across different services.


The right to object

Individuals must have an objection on “grounds relating to his or her particular situation”.

Where personal data might lawfully be processed because processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority, a data subject should be entitled to object to the processing of any personal data relating to his or her particular situation. It should be for the Council to demonstrate that its compelling legitimate interest overrides the interests or the fundamental rights and freedoms of the data subject.

Non Domestic Rates (Business Rates)

Non-Domestic Rates Service - How we use your personal information

Personal information, for the purpose of this Notice means data relating to living individuals which is held and processed by the Council in line with data protection rules.  Different rules apply to information held in respect of companies and other organisations and these are explained at the end of this Notice.

At Cannock Chase Council we take your privacy seriously and will only keep and use your personal information for reasons that the law requires or allows.  We are a data controller for the personal information we hold about you in relation to Non-Domestic Rates (sometimes referred to as business rates) administration and enforcement.  In order to comply with data protection legislation we want to be sure you understand how we use this information.

The purposes for which your data will be used are:-

  1. Ensuring that you are charged the correct amount of Non-Domestic Rates.
  2. Ensuring that you receive any reductions that you are entitled to.
  3. Determining any appeals received against Non-Domestic Rates liabilities including attendance at tribunals as necessary.
  4. Liaising with the Valuation Office Agency, as necessary, to enable them to maintain the Rating List.
  5. Issuing accurate and timely Non-Domestic Rate bills.
  6. Collecting, receiving and receipting payments made.
  7. Taking appropriate action when payment are not made on time, including the issue of recovery documents and notices and referring cases to courts as deemed necessary.
  8. Appointing and engaging agents and specialists in the enforcement of unpaid Non-Domestic Rates
  9. Preventing and detecting fraud and error within the Non-Domestic Rates, Council Tax system and/or Benefit system.

We are able to do this because legislation says we must do it and the processing is necessary for compliance with legal obligations.

We are required by law to hold and use some of your information for:

  • The administration, recovery and enforcement of Non-Domestic Rates
  • Preventing and detecting fraud and error within the Non-Domestic Rates system schemes or other areas.

We may share your information with;

  • Other agencies directly involved in administration, recovery and enforcement of Non-Domestic Rates (this would typically be the Valuation Office Agency, and agents or specialists acting for the Council in fulfilling its statutory duty)
  • Other councils or organisations as part of the national fraud initiative.

Otherwise, we will only share your data if you ask us to, or if it is in the public interest to do so and the law requires or allows us to.  Examples of where we may share your data are;

  • Notifying emergency services of properties that become unoccupied and therefore at risk of fire or criminal damage.
  • Notifying relevant Council officers of properties becoming unoccupied, in order that they may assist the owner to bring it back into use.
  • Providing appropriate authorities with details of the person responsible for a property that has been considered to be unsafe.

We only keep this data for the time specified in our retention schedule or as required by law. 

Your personal data is processed (including storage) within the European Economic Area only.

As far as possible, we will apply the same principles to a company or organisation’s data as we would to an individual.  However, legislation (particularly the Freedom of Information Act 2000) requires the Council to disclose information which we hold.  In particular we are regularly required to disclose the following information in respect of all businesses on our rating records;

  • Property info (such as address, property reference, rateable value etc)
  • Name of liable party
  • Amounts of rates payable
  • Any reliefs awarded
  • Whether the property is occupied or vacant.
  • Any accounts which have been overpaid.

Personal data about ratepayers who are individuals is redacted.

Benefits

Benefits Service - How we use your personal information

At Cannock Chase Council we take your privacy seriously and will only keep and use your personal information for reasons that the law requires or allows.  We are a data controller for the personal information we hold about you in relation to Housing Benefit and Council Tax Reductions.  In order to comply with data protection legislation we want to be sure you understand how we use this information.

The purposes for which your data will be used are:-

  1. Ensuring that you receive the correct amount of Housing Benefit
  2. Ensuring that you receive the correct amount of Local Council Tax Reduction
  3. Ensuring that you receive any other rebates or payments that you are entitled to.
  4. Recovering any overpaid Housing Benefit and/or Council Tax Reduction
  5. Assessing any Discretionary Housing Payments or Council Tax Reductions that we may be able to pay to you.
  6. Preventing and detecting fraud and error within the benefit system

  • Administering the Housing Benefit and Council Tax Reduction schemes.
  • Preventing and detecting fraud and error within those schemes or other areas.

DWP Data

The Council receives some personal data directly from the Department for Works and Pensions (DWP) and His Majesty’s Revenues and Customs (HMRC) so that we can deal with Benefit claims more quickly by reducing the amount of information that we ask you to send to us.

The Council will only use DWP derived data for the following purposes:  
•    Housing Benefit (HB) 
•    Local Council Tax Reduction (LCTR) 
•    Local Welfare Provision (LWP)
•    Discretionary Housing Payment (DHP)
•    Disabled Facilities Grant (DFG) 
•    Disability Adaptation Grant (DAG) 
•    Maintaining Council Tax accounts to help us to charge the right amount to the right people.

We receive this information in two ways
•    Electronic files sent securely to the Council.
•    Those Council Officers who are responsible for administering Benefit claims have direct access to a DWP system, called Searchlight.

Access to DWP data is very tightly controlled and involves measures over and above the Council’s ordinary Data Protection rules.  The Council agrees a Memorandum of Understanding with DWP each year.  This agreement controls the Council’s access to and use of the data and requires that:
•    All staff accessing DWP data have been vetted to Baseline Personnel Security Standard (BPSS) and undertake a mandatory training program which is refreshed annually.
•    The Council’s computer systems, control measures and cyber security are robust


We may share your information with;

  • Other agencies involved in the processing of benefits (this would typically be the Department for Works and Pensions, Her Majesty’s Revenue and Customs or the Valuation Office Agency).
  • Other councils or organisations as part of the national fraud initiative.
  • Your landlord, in limited circumstances only.

Otherwise, we will only share your data if you ask us to, or if it is in the public interest to do so and the law requires or allows us to. 

We sometimes collect information about people other than the person who has applied for a benefit or service. This is to enable us to work out what the applicant is entitled to. For example, where a person makes a claim for Housing Benefit and/or Local Council Tax Support, we need information about other people who live in the same household to work out how much the applicant will be paid.

We will sometimes need to test the impact on your claim of changes to your circumstances, legislation or processes, before applying the changes to your claim.  When we need to do this, we will use a copy of your claim data, which will be subject to the same level of control and confidentiality as your live claim.  This helps us to deal correctly with those changes without interruption to your claim or payments.

Application for a Market Stall (Cannock, Rugeley and Prince of Wales Markets)

Housing Services - How we use your personal information

At Cannock Chase Council we take your privacy seriously and will only keep and use your personal information for reasons law requires or allows.  We are a data controller for the personal information we hold about you in relation to Housing Services. In order to comply with data protection legislation we want to be sure you understand how we use this information.

We collect personal information about:

Housing Applicants: This includes anyone who is applying for housing from the Council and will include referrals (nominations) to other housing providers (e.g. Housing Associations) and could also include their family and people associated with them.

Tenants ◦ This includes current and former who live or have lived in our properties or access our support and other services, and could also include family details and people associated with them.

Leaseholders: This includes the leaseholder and could also include their family and people associated with them.

Customers /Visitors : Customers / Visitors to our website, our offices and  anyone who makes a complaint, complement or enquiry

Other persons and Residents: This includes people who are

  • helping and supporting family and friends with their housing applications or to manage their home or with problems relating to their tenancy

We collect information in a variety of ways including

  • Council’s website via Housing Self Service and other web forms for requests for service or applications.
  • on various forms, such as housing applications, medical and social need assessment forms, vulnerable decorating and grass cutting, support and care plans,

  • tenancy agreements, and contracts such as leasehold agreements
  • financial records such as rent accounts

When you apply for housing advice and assistance (Housing Options and Homelessness), to become a Cannock Chase Tenant (housing applicant), we request and hold on file information and any references necessary to assess your application including as appropriate (but not limited to) references from:

  • other housing providers/private landlords:
  • your mortgage lender (if you own/have owned your own home),
  • the Police,
  • the Probation Service,
  • Citizens Advice,
  • support workers,
  • social workers,
  • mental health workers and
  • credit reference agencies.

Where this is the case, we will request your permission to collect such information.

As a Council Tenant if you are experiencing any problems, such as debt, rent arrears, anti-social behaviour or applying to purchase your home we will also request and hold on file information and any references necessary to assist and assess your application including as appropriate (but not limited to) information from:

Who we share your information with

We may share your information with third parties to help us to deal with your request for housing and management of your tenancy more efficiently and effectively. When sharing information we will comply with all aspects of Data Protection legislation. Where necessary or required, we may share your personal information as follows:

  • with our contractors, in order to undertake repairs, maintenance or improvement works (e.g. plumbing, electricians, gas heating, kitchen and bathroom installers), utililty companies and IT Services
  • with landlords, housing associations and trusts, in connection with tenancy references and associated enquiries.
  • with community partners in connection with the delivery of co-ordinated local services.
  • with local authorities and government departments, as necessary for administering justice, or for exercising statutory, governmental, or other public functions.
  • with police and other relevant authorities (e.g. Probation Service, Department of Work & Pensions, HM Revenues & Customs) in relation to the prevention or detection of crime and fraud; the apprehension or prosecution of offenders and the assessment or collection of tax or duty.
  • with other statutory organisations, e.g. social services and health authorities, as necessary for exercising statutory functions.
  • with utility companies and Council Tax offices to ensure billing details are correct.
  • with authorised debt recovery agencies, to enable them to recover the debt.
  • with external debt advice agency to discuss financial situation, rent payments (including any arrears) and any claims made for welfare benefits.
  • With credit reference agencies to assess your financial standing
  • With DWP to verify Universal Credit application and manage these payments.

This list is not exhaustive as there are other circumstances where we may also be required to share information particularly in order to meet our legal obligations. We will use all information held by us for the purposes of law enforcement, regulation and licensing, criminal prosecutions and court proceedings

Personal information will be kept secure and confidential. Officers have restricted access to personal information on a “need to know” basis.  We may share information with contractors, or agencies we work with, such as Health, Social Services, Police and other social landlords, We will also disclose information as required by law.


The legal basis under which we are processing your information

We are able to process your information as above because the processing of this information is necessary for compliance with legal obligations primarily under the Housing Act 1988, 1996, and 2004, the Housing (Homelessness) Act 2002 and the Homelessness Reduction Act 2017, Localism Act 2011, Protection From Eviction Act 1977 to which we are subject. Some processing will be necessary for the performance of tasks carried out in the public interest or in the exercise of official authority vested in us and other processing will be necessary for the performance of our contractual obligations under any tenancy, or lease, agreement between us.

Building Control

Building Control - How we use your personal information

The purposes for which your data will be used are:-

  1. Processing submitted applications for approval under the Building Regulations from initial submission through to issuing a completion certificate.
  2. Ensuring that reports of Unauthorised Works are assessed and acting upon accordingly.
  3. Providing fee quotations to enable an application to be submitted.
  4. To provide pre-application advise to customers who are proposing works that may require Building Regulations.
  5. Ensuring the registration of Initial Notices are processed accordingly.
  6. Ensuring that Sections 80 Demolition notices are registered and processed accordingly.

We are able to do this because legislation under The Building Act 1984  says that we can and it is in the public interest. The main rules are contained in the following statutes and subsequent amendments to them.

  • The Building Regulations 2010 and any subsequent amendments.
  • The Building (Approved Inspector) Regulations 2010 and any subsequent amendments

We may share your information with;

  • Other internal departments directly involved in recovery of outstanding monies or enforcement of the building regulations, dangerous structures or demolition works where necessary.
  • Other Local Authorities when applications are submitted under the LABC Partnership scheme.
  • The Fire and Rescue Service as required by the above legislation and to ensure buildings comply with fire safety legislation.
  • Other consultees necessary to ensure construction work complies with the building regulations. eg. structural engineers

Otherwise, we will only share your data if you ask us to, if it is in the public interest to do so and if the law requires or allows us to.

Insurance

Planning Policy

At Cannock Chase Council we take your privacy seriously and will only keep and use your personal information for reasons law requires or allows.  We are a data controller for the personal information we hold about you in relation to Planning Policy.  In order to comply with data protection legislation we want to be sure you understand how we use this information.

The purposes for which the data will be used are:-

  • To maintain an up to date, confidential consultation data base so that we can ensure we are consulting those we are required to by law as listed in the relevant regulations, and anyone who has given their consent to us holding their data to enable us to keep them personally informed of consultations run by the planning policy team (name, address / email address). Individuals can unsubscribe to this data base at any time.
  • For the formulation of Local Plans. Local Plans determine land use and planning policy for the area which then sets the context for making decisions on planning applications. The production of these is strictly regulated and we will consult on these using the information held on our   database. When you submit comments to a Local Plan consultation your name and your comments will be made public. All other personal information will be held confidentially. When we consult on the ‘proposed submission’ stage of the Local Plan (ie the version intended to be submitted to the Planning Inspectorate for independent examination in public), and on any subsequent modifications the information you submit when making your comments will need to be shared with the Planning Inspectorate. This will include personal information (name and contact details) so that they can contact you to enable you to participate in the examination process. We will make this clear on our consultation forms for this stage of the process.
  • For the formulation of Supplementary Planning Documents and other planning policy documents. These documents supplement and add detail to adopted policy in the Local Plan. We will consult on these using the information held on our planning policy database. When you submit comments your name and your comments will be made public. All other personal information will be held confidentially.
  • For revisions to the Statement of Community Involvement. This is a statutory document which we produce to show how we will engage the community in the planning process. When we make substantive changes to this we will publicly consult, using the information held on our planning policy consultation database. When you submit comments your name and your comments will be made public. All other personal information will be held confidentially.
  • For fulfilling our legal duties in relation to the production of .Neighbourhood Plans. Parish Councils or certain other community bodies can choose to produce these but the District Council has a legal duty to consult at certain stages of the process and will use the planning policy consultation database for this purpose. When you submit comments your name and your comments will be made public. All other personal information will be held confidentially. Your personal data will not be shared with the appointed independent examiner.
  • Call for Sites submissions. Call for Sites forms part of the evidence base required for local plan preparation. Landowners, developers and agents are publicly invited to submit sites which they would be interested in developing to the local planning authority: details of site submissions will be not be confidential with the exception of personal data ie phone number, address / email address.
  • The Brownfield Land Register. Local Planning Authorities are legally required to maintain and publish a register of previously developed land. The brownfield register forms part of the evidence base required for local plan preparation. Landowners, developers and agents are publicly invited to submit sites via the Call for Sites process which they would be interested in developing to the local planning authority: details of site submissions will be not be confidential with the exception of personal data ie phone number, address / email address.
  • The Self Build and Custom Build register. This is a record of people wishing to build their own dwelling within the district.  In requesting to be added to the database, personal information is required which is set out in the Self-build and Custom Housebuilding (Register) Regulations 2016 which also sets out the process for removal from the register. Your personal information will not be published but data may need to be shared with other departments in helping the Council fulfil its duty in delivering sufficient plots.
  • Conservation Area Appraisals and Management Plans. It is the duty of the Local Planning Authority to formulate and publish proposals for the preservation and enhancement of the conservation areas and for their management. When we are required to consult on these we will carry out a targeted consultation to occupiers of properties within the relevant conservation area. When you submit comments your name and your comments will be made public. All other personal information will be held confidentially.
  • Community Infrastructure Levy Charging Schedule. This is a schedule of charges levied on certain types of development. When we review this we will be required to consult and will use the information held in the planning policy consultation database.

When you submit comments your name, and that of the person or organisation you represent will be published. All other personal information will be held confidentially. In respect of elections, we may also keep records about candidates and their agents, subscribers to a candidate’s nomination; candidates’ guests at a count; polling station key holder / contact details; and temporary employees employed in order to satisfy statutory criteria relating to the administration of elections.  Certain of this information may be required to be made public.

We may share electors’ information with:

  • Contracted printers to print poll cards; postal ballot packs and other electoral material.
  • Political parties, candidates at elections and holders of elected office to use the register for electoral purposes.
  • The Council and the British Library hold copies that anyone may look at under supervision.  Copies are also held by the Electoral Commission, the Boundary Commissions (which set constituency boundaries for most elections) and the Office for National Statistics.
  • The Council can use the register for duties relating to security, enforcing the law and preventing crime.  The Police and the security services can also use it for law enforcement.
  • HM Courts and Tribunals Service uses the electoral register when calling people for jury service.
  • Government departments may buy the register from local Registration Officers and use it to help prevent and detect crime.  They can also use it to safeguard national security by checking the background of job applicants and employees.
  • Credit reference agencies are entitled to buy the register to help them check the names and addresses of people applying for credit.  They also use it to carry out identity checks when trying to prevent and detect money laundering.

It is a criminal offence for anyone being supplied with a copy of the register to use it for anything other than the purpose stated.

Otherwise, we will only share your data if you ask us to, or if the law requires or allows us to.

Partner organisations

To verify your identity, the data you provide will be processed by the Individual Electoral Registration Digital Service (IERDS) managed by the Cabinet Office.  As part of this process your data will be shared with the Department of Work and Pensions (DWP) and the Cabinet Office suppliers that are data processors for the IERDS.   • The DWP use data provided to verify the identity of new applicants.
  • The IERDS will inform the old local authority of people who have moved area.
  • Information will be processed within the European Economic Area (EEA) and will not be shared with overseas recipients.

If your details are in the Open version of the Electoral Register, your name and address can be sold to third parties who may use it for any purpose.

You can opt out of this version at any time and are given the opportunity annually as part of the Canvass of all households.

Licensing

In order to comply with data protection legislation we want to be sure you understand how we use this information.

The purpose for which your data will be used is to establish your identity and other necessary information about you which will help us determine your fitness, propriety and suitability to hold a licence or other authorisation with this authority. 

If you are a hackney carriage/private hire driver, we may also use your data to enable the maintenance of a national revocations and refusals register (NR3) to strengthen hackney carriage / private hire vehicle licensing for the benefit and safety of passengers and drivers.

The introduction of this NR3 register will help other licensing authorities to make decisions on whether or not you are a fit and proper person to hold a licence with that authority.  This is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the licensing authority.

The recipients or categories of recipients of the personal data in the case of the NR3 National Register of Refusals or Revocations will be the National Anti Fraud Network and Licensing Authorities

Taxi and Private Hire Licensing

At Cannock Chase Council we take your privacy seriously and will only keep and use your personal information for reasons that the law requires or allows.  We are a data controller for the personal information we hold about you in relation to the processing and renewals of your dual badge driver licence and/or your vehicle licence.  In order to comply with data protection legislation we want to be sure you understand how we use this information.

  2. To confirm your current address and operating base if applicable.
  3. To establish your immigration status and the Right to Work in the UK.

Our finance teams process personal information in order to send out invoices, pay invoices, and recover debts.

The Council also process customer payments for Council Tax, Business Rates (NNDR), Housing Benefit Overpayments, Mortgages, Penalty Charge Notices / Parking Fines, Rents and Invoices. This is a hosted service by Capita, who are GDPR compliant.

The information is processed to generate/pay an invoice for goods and services received/provided or whereby an individual or organisation has been overpaid, the information is processed in accordance with the Local Government Finance Acts of 1972/1988 and to meet contract requirements.

In addition, we may use any of the information you provide to us for the prevention and detection of fraud. We may also share this information with other bodies responsible for auditing, administering public funds, or where undertaking a public function, in order to prevent and detect fraud.

Payments in the main are made by BACS or in certain circumstances by cheque whereas income is collected by Direct Debit or via Card payments by Telephone

Information we may collect about you 
We may collect and process the following data about you - information you give us, information we collect about you and information we receive from other sources: 
·    You may give us information about you by filling in forms on our site or by corresponding with us by phone, e-mail or otherwise. This includes information you provide when you make an enquiry regarding a job vacancy, make an application for employment, liaise with us regarding any application or offer of employment, when you register to use our site, participate in negotiations regarding an offer of employment or any other recruitment activity. The information you give us may include your name, address, e-mail address and phone number, contact preferences, date of birth, qualifications, educational and employment background, financial information and personal description, as well as details of the job(s) for which you wish to apply.  
·    So that we are able to monitor our recruitment practices, the Council is also required to ask for information considered to be sensitive personal data or a ‘special category’ of personal data under the data protection legislation. This includes information about your ethnic or racial origin, religious or similar beliefs, physical or mental health, sexual orientation and criminal convictions. This sensitive data is requested in the Diversity and Equalities section of the application form or on the appropriate disclosure forms and is excluded from the shortlisting process. If you are successful in your application and appointed, the information will be held on your personal record. Equal Opportunities and Diversity Monitoring information will be also retained in the ATS system after the conclusion of any recruitment campaign but only as anonymised information and this does not identify you personally.
•    Where an application is progressed further, we will undertake pre-employment checks in order to verify or obtain extra information, which may include background and security checks such as credit reference, NI checks, right to work in the UK, criminal record checks, academic qualification checks and employer references as relevant to the post. 
•    The completion of a medical questionnaire is our other employment check. This is also regarded as sensitive or ‘special’ information within data protection legislation and can only be accessed by our Occupational Health supplier. After reviewing your form or discussing the content with you, Occupational Health provide the Council with guidance on whether you are medically fit to undertake the duties of the post you applied for.
•    Cannock Chase District Council and Stafford Borough Council operate a shared service arrangement for some of its functions. In these cases personal data may be passed to authorised employees of either Council for the purposes of carrying out those functions only. It will not be used for any other purpose except as authorised by law.
•    As we often work with partner organisation’s to deliver some of our services, on occasions an appropriate member of the partner organisation may also form part of the interview panel. To undertake these duties, they will have access to a copy of your application form. After completion of the recruitment process, all applications including those accessible in these circumstances will be destroyed for unsuccessful candidates in a secure manner. 
•    From time to time, we also work closely with third parties (including, for example, recruitment agencies, head hunters, search information providers, and organisations specialising in psychometric testing. For the purposes of continuing your application, we may need to provide to them with information or receive information about you from them. Where this applies, we will let you know.
•    Occasionally, partner organisations also advertise vacancies on recruitment system. No information is collected by the Council in this instance, it is used purely a signposting tool to the partner organisation. If you are directed to another website, we are not responsible for third party websites and you are advised to review their privacy policy.

Uses made of the Information
We use information held about you in the following ways:
•    To communicate with you, to manage our recruitment and hiring process, to determine your initial and ongoing suitability for employment, to invite you to participate in voluntary surveys so we can assess and improve the candidate experience, and to determine terms of employment or engagement; 
•    To ensure compliance with corporate governance, legal and regulatory requirements;
•    To carry out our obligations arising from any contracts entered into between you and us;
•    To notify you about any changes to our service;
•    The information may also be included in management data used to monitor recruitment initiatives and equal opportunities, or management data responses to Freedom of Information requests. This information will always be anonymised.

Security of your data
The Council has contracted Engage ATS (Havas People) to provide and manage this applicant tracking system for us. Engage ATS use industry wide standard security measures including secure servers, firewalls and SSL encryption to safeguard personal information and ensure that it is collected and stored securely against unauthorised access in accordance with data protection legislation. Engage ATS are also accredited with ISO27001 which is the international security standard for information security. 
It is important that when you register an account you:
•    Keep your password confidential and agree not to disclose your password to anyone else.
•    If concerned that your account could have been compromised e.g. someone has discovered your password, it is important that you change your password and contact us straight away.

Disclosure of your information 
We may share your information with selected third parties including:
·    Business partners, suppliers and contractor organisations supplying services which require the use of your data for the purposes described in this privacy statement or for the performance of any contract we enter into with them or you, for example occupational health; 
·    Organisations specialising in the assessment of candidates, including psychometric, verbal and numerical reasoning testing;  
·    To confirm factual information provided by you or to conduct necessary pre-employment checks, including contacting the referees you have supplied;
•    The Council is under a duty to protect the public funds it administers, and to this end may use the information you have provided in your application for the prevention and detection of fraud. The Council may also share this information with other bodies responsible for auditing or administering public funds for the same reason, or parts of the Council or other relevant organisations for purposes which may include enforcement.
•    If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply other agreements; or to protect the rights, property, or safety of Stafford Borough Council, Cannock Chase District Council, our customers, or others. 

Retention

We will retain your data during the recruitment and selection process. 

We will only retain your data afterwards if there is a legal obligation to do so (for example, for the purposes of administering the employment relationship). We may also retain your data if there is a ‘business need’, for example, retaining your application on file if a suitable vacancy arises, or for the purpose of responding to employment tribunal claims arising out of the recruitment process. 

For unsuccessful candidates, the application data will be retained for a maximum period of 12 months from the date of the application registration, and for appointed applicants your application and other information, including pre-employment information will form part of your employee file held by the Council. 

Should you wish to request a change to this normal practice, or for the information to be retained for longer than the 12 month period, please contact a member of the HR Services team.

Closed Circuit Television (CCTV)

“Personal data” is any information about a living individual, which allows them to be identified from that data (for example a name, photographs, videos, email address, or address).

Identification can be by directly using the data itself or by combining it with other information, which helps to identify a living individual.

What personal information is being processed and what for?

Cannock Chase Council is the data controller and has installed CCTV (Closed Circuit Television) cameras in various locations within the borough for the purposes of reducing crime, disorder, anti-social behaviour and the fear of crime by helping to provide a safer environment for those people who live and work in the area and for visitors travelling through the area. Recordings also provide enforcement agencies with evidence of criminal activity, for formal actions including prosecutions in court and identification of offenders in investigations.

These recordings contain images of the public going about their daily business as well as offenders, wanted people and missing persons. On occasions where RIPA applies, this may include targeted footage of private property.

The following are the key purposes for which we use CCTV systems:
• to help reduce crime and anti-social behaviour;
• to help reduce the fear of crime;
• to help detect crime and provide evidential material for court proceedings;
• to provide assistance in the overall management of public health and safety;
• to assist the local authorities in their enforcement and regulatory functions within the area of Cannock Chase;
• to safeguard vulnerable adults and children;
• to assist in developing the economic well-being of Cannock Chase District and to encourage greater use of the town centres, shopping areas, car parks and similar locations within the district.

Why we are allowed to use your information?

The legal basis for using the information you provide us is:

  • for the interest of public safety, the prevention and detection of crime, apprehension and prosecution of offenders and for legal proceedings
  • public task: the processing is necessary for us to perform a task in the public interest or for our official functions, and the task or function has a clear basis in law
  • in some circumstances - Vital interests: the processing is necessary to protect someone’s life

The lawful basis for holding and processing the data comes under:

  • Section 163 of the Criminal Justice and Public Order Act 1994
  • Crime and Disorder Act 1998
  • Protection of Freedoms Act 2012
  • In certain Circumstances - Regulation of Investigatory Powers Act

We also use your personal data for some or all of the following purposes:

  • to deliver public services, including to understand your needs to provide the services that you request and to understand what we can do for you and inform you of other relevant services.

Who we will share your information with?

Information will be shared with:

  • CCTV operators
  • Internal/External enforcement agencies Trading Standards, HMRC.
  • Police Forces
  • Fire and Rescue Services
  • with members of the public under very strict Data Protection or Freedom of Information conditions
  • we will also share information with Insurance Companies where allowed by law
  • we will share details of those convicted with local crime reduction partnerships.

Where we get your information from?

From CCTV Cameras feeding live video images into the CCTV control room, Police, Airwave Radio, Shop and Pubwatch radio, emails, and from phone callers.

How long we will keep your personal information?

CCTV recordings are automatically held for 30 days. Manually saved footage may be held for up to 60 days. Footage retained for evidential purposes is held for 3 years. In exceptional circumstances and only where an investigation, trial or appeal is ongoing, these may be retained longer than 3 years and until case conclusion.

How your information is stored?

CCTV video images are recorded in real time onto a secure system which is standalone and not connected to any internal or external network.

Other information is held on a secure electronic database hosted on the Council’s secure internal network and both are fully access restricted / auditable.

Will your information be used to make automated decisions?

Will this information be transferred abroad?

Teleservices / Out of Hours Service / Social Alarms Service

Cannock Chase Council is working in  Partnership with NEW Lifeline Telecare Service, Redditch Borough Council to provide a Social Alarm installation and monitoring service in the Cannock Chase area.

All calls are answered by operators at Redditch BC who provide a 24/7 monitoring service.

Monitoring Centre Operators will speak to clients, assess a situation and call nominated emergency contacts or request 999 emergency help where necessary. 999 services continue to allocate emergency vehicles/support from the local area.

There is an installation team based in Cannock who will assess your equipment needs.

NHS Test and Trace Payments

Self-Isolation Payment Privacy Notice

On 28th September 2020, the Government passed into law a national Test and Trace Support scheme. From 12th October, a one-off payment of £500 or access to a discretionary fund will be available for eligible individuals. More information about this scheme can be found here.

If you apply, we will need to process your personal data to assess whether you are eligible to receive financial support, and if so, to provide a payment to you.  This Privacy Notice sets out what personal data we will use, how we will use it, and why we need to, when an applicant applies for this support.

Data Controller

The Department of Health and Social Care (DHSC) has commissioned NHS Test and Trace on behalf of the government and is the data controller for the purposes of providing Test and Trace data to Cannock Chase Council.

Cannock Chase Council. are the data controller for the purposes of assessing eligibility, administering and making payments under the Test and Trace Support scheme.

New package to support self-isolation

If you have been told by the NHS to self-isolate, either because you have tested positive for COVID-19 or you have been in contact with someone who has tested positive, you may be entitled to some financial support during your self-isolation period.

What are Self-Isolation Payments?

People who are eligible will receive:

A £500 one-off Test and Trace Support payment or provision from the discretionary fund to remain at home to help stop the spread of the virus.

Categories of personal data we collect and process

We collect and process the personal data that you provide to us when completing your application for a self-isolation support payment, which may include:

  • Full name;
  • Full residential address;
  • Email address;
  • Mobile telephone number;
  • Home telephone number;
  • Proxy applicant details (as above where you may nominate someone else to complete this application on your behalf);
  • Employer name and address;
  • NHS notification number (the unique reference you will be given by NHS Test and Trace Service to self-isolate);
  • Bank account details;
  • Your National Insurance Number;
  • Proof of self-employment e.g. recent business bank statement (within the last two months), most recent set of accounts or evidence of self-assessment

Source and categories of personal data

We will obtain data from the NHS Test and Trace Service to confirm that you have either tested positive for COVID-19 or you have been in close contact with someone who has tested positive for COVID-19.  As this data is related to your health it is referred to as ‘special category data’.

You or your nominated representative will also provide us with additional personal data in relation to your application for a Self-Isolation Payment.

What we use your personal data for

We will carry out checks with the NHS Test and Trace Service and the Department for Work and Pensions (DWP), for verification purposes, Her Majesty’s Revenue and Customs (HMRC), for tax and National Insurance purposes, and potentially with your employer in validating your application. 

Information relating to your application will also be sent to the DHSC to help understand public health implications, allow us to carry out anti-fraud checks and determine how well the scheme is performing.

We will not share this data with other organisations or individuals outside of Cannock Chase Council for any other purpose.

We will provide information to HMRC in relation to any payments we make because Self-Isolation Payments are subject to tax and National Insurance contributions. If you are self-employed, you will need to declare the payment on your self-assessment tax return.

Our lawful basis for processing the personal data

We must have a legal basis to process your personal data. Our lawful basis in the processing that we’ll undertake in assessing your eligibility for, and in making any self-isolation payment to you, is based on a legal obligation.

Where we use personal information to confirm that someone is eligible for a self-isolation payment, the sections of the law that apply are:

  • GDPR Article 6(1)(e) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller
  • GDPR Article 9(2)(i) – processing is necessary for reasons of public interest in the area of public health, such as protecting against serious cross-border threats to health or ensuring high standards of quality and safety of healthcare;
  • Data Protection Act 2018 Schedule 1 Part 1 (2) - health or social care purposes

Separately, we have special permission from the Secretary of State for Health and Social Care to use confidential patient information without people’s consent for the purposes of diagnosing, recognising trends, controlling and preventing, and monitoring and managing communicable diseases and other risks to public health.

This is known as a ‘section 251’ approval and includes, for example, using your test results if you test positive for COVID-19 to start the contact-tracing process.

The part of the law that applies here is section 251 of the National Health Service Act 2006 and Regulation 3 of the associated Health Service (Control of Patient Information) Regulations 2002.

Cannock Chase Can mobile application

At Cannock Chase Council, we take your privacy seriously and will only keep and use your personal information for reasons that the law requires or allows.  Cannock Chase is the data controller for the personal information we hold about you in relation to the Cannock Chase Can mobile app. 

WHY ARE WE COLLECTING YOUR PERSONAL DATA?
The purpose of the data processing will ensure the features within the mobile app are tailored to the individual users’ needs and requirements. For example, gender, weight, and year of birth is to enable the application to allow the user to set their weight goals. 

The data is then used to show the user their individual progress across the various areas of the wellness wheel and promote relevant challenges within the application.

The data will be used by the Council to identify the impact of the application on the District’s local obesity and wider health levels; and show where there has been a reduction or increase. 

It will also help determine the overall success and value of the Cannock Chase Can programme. 

The Council will be able to use the data to potentially target and further assist certain postcode areas and/or certain groups (e.g., age and/or gender).

The Council will also use this data for marketing purposes in the form of digital notifications. Users of the app will be sent personalised notifications based on their progress within the app. This could include updating progress on their Wellness Wheel and challenge updates and reminders. 

Users will have a choice whether they wish to receive  these notifications and can opt to ‘turn off’ notifications using the system preferences on their device. 


WHAT INFORMATION DO WE COLLECT?
We collect personal information that you voluntarily provide to us during the registration stage of the app. 
 
The personal information we collect will include the following:
•    User details: username, IP address, postcode, telephone number, email address, year of birth, gender, body weight, height, and lifestyle options.

User activity data will also be logged throughout the usage of the application. These metrics will be stored against the ID of the user and will be used to show the user their progress across the following metrics:
•    Weight change
•    Challenge activity
o    Challenge started
o    Challenge completed
o    Challenge aborted
o    Challenge progress recorded
•    Activity group score was updated
•    Wellness Wheel score was updated

Note, the usage of this reporting data will be anonymised from any personally identifiable information. 

DO WE COLLECT INFORMATION FROM UNDER 18’s?
We do not knowingly collect data from or promote to children under 18 years of age.

HOW WILL YOUR INFORMATION BE STORED?
The nature of the processing will consist of the Council collecting user data when people download and register with the mobile app as shown below:
1.    Data will initially be entered into a user’s mobile device by the user
2.    This will be sent via TLS Encryption to the API, hosted by AWS
3.    The API will then send the data via TLS Encryption to the database. The database will be an AWS RDS database

Your personal data is stored within the UK only 

DATA SECURITY
All information you provide to us is stored on our secure servers. 

A Creative Team will compile and store the data on the Council’s behalf to enable them to complete their contractual obligations and provide a suitable application for end users as part of the Cannock Chase Can programme. They are classed as data processors for the purposes of current data protection legislation.

Once we have received your information, we will use strict procedures and security features to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way. 

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator when we are legally required to do so.

WILL YOUR INFORMATION BE SHARED WITH ANYONE?
Your information may be shared with other departments within the Council for reporting purposes and to develop initiatives that target particular postcode areas of the District. This is outlined in the ‘Why are we collecting your data’ section. 

Note, the usage of this reporting data will be anonymised from the personally identifiable information. 

Your personal data will not be shared with any other third parties. 

HOW LONG DO WE KEEP YOUR INFORMATION?
Your information will be stored for the duration of the Cannock Chase Can programme, up to a maximum of 5 years.

HOW DO WE HANDLE YOUR SOCIAL LOGINS?
If you choose to register or log in to the Cannock Chase Can mobile app using a social media account, we will have access to certain information about you.
 
The mobile app offers you the ability to register and login using your third-party social media account details (like your Facebook or Twitter logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. When a user chooses to login using social media, the information collected will include their first and last name and their email address.  

We will use the information we receive only for the purposes that are described in this privacy notice. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their sites and apps.

Chase Community Games 2022

Council Tax Energy Rebates

Council Tax Energy Rebates - How we use your information.

At Cannock Chase Council we take your privacy seriously and will only keep and use your personal information for reasons that the law requires or allows.  We are a data controller for the personal information we hold about you in relation to Council Tax Energy Rebate payments.  In order to comply with data protection legislation we want to be sure you understand how we use this information.
The purposes for which your data will be used are:-
1.    Ensuring that you are paid the Energy Rebate if you are entitled to it.
2.    Verifying the validity of bank details provided to receive payments, using approved online systems.
3.    Ensuring that payments are made in the most effective way.
4.    Verifying your application against our Council Tax records and updating Council Tax records if they are shown to be incorrect, as a result of information provided on a Rebate application.
5.    Ensuring that rebate payments are not made to people who make fraudulent applications.

We are able to do this because the Government has required the Council, as a Billing Authority to manage the Energy Rebate Scheme insofar as it affects residents in our area.    The scheme details are included in guidance given to Local authorities on 16 March 2022, available in full here .  This may be updated from time to time.
The scheme requires the Council to refence Rebate applications to its Council Tax records.  The relevant legislation governing the maintenance of Council tax records includes; 

  • Local Government Finance Act 1988
  • Local Government Finance Act 1992
  • Council Tax (Administration and Enforcement) Regulations 1992
  • The Council Tax (Exempt Dwellings) Order 1992
  • The Council Tax (Discount Disregards) Order 1992

  • We are required by law to hold and use some of your information for:

  • Notifying relevant Council officers of properties becoming unoccupied, in order that they may assist the owner to bring it back into use.

Online Payments

Who is collecting and using your personal data?

Cannock Chase Council is the data controller for any personal data supplied as part of any transaction you make.
Civica UK is the provider of the secure online payment system which allows us to collect payments online. In this instance they are acting as a data processor on our behalf.

Why are we collecting your personal data?

Upon supplying your personal data, the Council and our contractor (Civica UK) will use your personal data to administer your transaction. Failure to provide your personal data will mean that the Council is unable to process your transaction.

Energy Bills Support Scheme Alternative Funding (EBSS AF)

How we use your personal information
At Cannock Chase Council we take your privacy seriously and will only keep and use your personal information for reasons that the law requires or allows.  We are a data controller for the personal information we hold about you in relation to the administration of this government scheme.  In order to comply with data protection legislation, we want to be sure you understand how we use this information.
The EBSS Alternative Funding is a one-off £400 non-repayable discount to eligible households who have not received the main EBSS payment automatically to help with their energy bills between 1 October 2022 and 31 March 2023, but are still facing increased energy costs. Individuals will need to apply for the EBSS Alternative Funding via a Gov.UK portal. Local authorities will be responsible for distributing support payments to eligible applicants.

Your data
We will process the following personal data:
•    your name, where you live, date of birth, postcode and address, including when using the address lookup function
•    your email and phone number when you have provided them
•    bank account details to help us identify you and facilitate payment
•    questions or feedback you leave, including your email address if you contact us
•    evidence of power of attorney or other legal evidence to act on the applicant's behalf
Special category data will not be expressly requested in connection with applications for the scheme, but it is possible that co-incident collection and sharing of special category data could occur as a result of information provided by applicants (or third party individuals acting on your behalf) in connection with the applications, including, but not limited to, information relating to the ethnic origin of applicants or data concerning applicant's health or age.

Purpose
The purposes for which your data will be used are:
•    To proceed with delivery of the service, also known as the Energy Bills Support Scheme (EBSS) Alternative Funding in Great Britain, previously referred to as the Energy Bills Support Scheme Discretionary Funding, to ensure support to around 1% of households that will not receive £400 automatically through EBSS. This includes monitoring the reach of the scheme across regions and vulnerable groups.
•    To conduct financial checks on payments including for assurance and the prevention, investigation, detection or prosecution of criminal offences including fraud.
•    To allow BEIS to evaluate the scheme to understand its impact and to inform future government policy.

Legal basis of processing
We are able to do this because legislation provides a legal basis for processing your personal data.  The EBSS Alternative Funding is underpinned by the Energy Prices Act 2022. That Act allows for the government to issue support for energy costs (section 13) and enables government to empower delivery partners to provide the support to recipients (section 15). The Act, and subsequent regulations, also provides for delivery of the funding through local authorities in Great Britain as Local Welfare Provision. The Energy Prices (Designated Domestic Energy Price Reduction Schemes for Great Britain and Designated Bodies) Regulations 2022 (also in force) extends this designation to all district councils in England.  
Processing of your data is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller, such as the exercise of a function of a local authority , the Crown, a Minister of the Crown, or a government department; the exercise of a function conferred on a person by an enactment; the exercise of a function of either House of Parliament; or the administration of justice. In this case, to ensure support this coming winter to around 1% of households that will not receive £400 through EBSS automatically.
The Council will process and store your data only within the European Economic Area.

Data Sharing
We may share your information with the Department for Business, Energy and Industrial Strategy (BEIS)
We have a data sharing agreement with BEIS so that we can share your personal data with your them to deliver this service.  The sharing of the data between local authorities and BEIS is for the purpose of administration, delivery, reporting, monitoring, evaluation and fraud prevention necessary within the scheme. This may also include an assessment of your liability for council tax on the property you have stated as your sole and main residence on the application.

Retention
We will only keep your personal data for as long as required to support the delivery, evaluation and scrutiny of the service.   BEIS have indicated that data relating to this scheme will be retained for a period of 7 years.

Special category data
As referenced under sub-section “Your data” above, special category data will not be expressly requested in connection with applications for the scheme, but it is possible that co-incident collection and sharing of special category data could occur as a result of information provided by applicants (or third party individuals acting on your behalf) in connection with the applications, including, but not limited to, information relating to the ethnic origin of applicants or data concerning applicant's health or age.
To the extent that special category data is collected, it will be processed under Article 9(2)(g) of the UK GDPR – Substantial Public Interest. More particularly in the context of the exercise of governmental functions, preventing or detecting unlawful acts, regulatory requirements relating to unlawful acts and dishonesty, and preventing fraud, as set out in Part 2 of Schedule 1 to the DPA. In particular, this processing is necessary for the administration, delivery, reporting, monitoring, evaluation of the scheme, as well as in connection with fraud prevention, and pre- and post- payment assurance and financial management activities to be undertaken in connection with the scheme.

Energy Company Obligation (ECO4) / OFGEM Schemes

At Cannock Chase Council we take your privacy seriously and will only keep and use your personal information for reasons that the law requires or allows.  Cannock Chase Council is the data controller for the personal information we hold about you in relation to processing of applications for flexible eligibility for OFGEM administered schemes, predominantly, but not restricted to Energy Company Obligation (ECO.).  In order to comply with data protection legislation we want to be sure you understand how we use this information.

The purposes for which your data will be used are:-
1.    Confirming eligibility for schemes as required by OFGEM
2.    Proving this information to obligated suppliers, and contractors, as well as OFGEM as part of their auditing processes

Flood Recovery

Privacy Notice 

The information you provide will be used by Cannock Chase Council and Staffordshire County Council to process your claim. It may also be used by other partners with statutory interests in flooding including the Environment Agency and Severn Trent, to understand the nature of past flooding. It may also be used by Cannock Chase Council, Staffordshire County Council, other government agencies and departments for the purposes of administering the flood recovery framework.

We may be required to share this data with our professional partners, Staffordshire County Council, Environment Agency and Severn Trent to help us fully investigate and secure flood defence funding. There may be a requirement to share this information with other District Council internal departments, Government departments/agencies and public bodies, and Risk Management Authorities where the law allows. We may be required to share this information with other government agencies and departments for the purposes of administering the flood recovery framework where the law allows. 

This information will not be shared publicly and will not be shared within any insurance related companies. We will not identify your property as having previously flooded with any public or private body not listed without your express consent. 

We may need to contact you to ask more questions about flooding in the future.

In cases of suspected fraud your data may be passed to the police to conduct an investigation.  We may also share your data if we are required to do so by law, for example by court order or to prevent fraud or other crime.

The Council will keep your data for a maximum of 7 years after the date of our last contact with you.

You have the following rights:

-you have the right to be informed via Privacy Notices such as this

-you have the right to request access to and to receive a copy of any information we hold about you (including in an electronic format) - to request a copy of this information you must make a subject access request in writing

-if you find that the information CCDC holds about you is no longer accurate, you have the right to ask to have this corrected

-you have the right - under certain conditions - to ask us to erase your personal data

-you may request that CCDCstops processing your personal data in relation to any council service (this may delay or prevent us delivering a service to you, we will seek to comply with your request but may be required to hold or process information to comply with our legal duties)

You also have the right to make a complaint to the Information Commissioner's Office (ICO). This is an independent body responsible for making sure that organisations comply with Data Protection legislation.

The ICO will always expect you to have raised your concerns with us before submitting a complaint.
